The use of this website and the products WHD sell from this website are subject to the following terms and conditions. By using this website you agree to all the terms and conditions. These terms and conditions may be amended by us, at any time and without notice and you should check this page before placing an order.
We do not guarantee that this website will always be available and we can withdraw or amend the service without notice. We will not be liable if for any reason this website or any part of it is unavailable.
1 The Contract between You and Us
a By placing an order you undertake that all the details you provide are true and accurate and that you are offering to purchase products subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
b In order to enter a contract with us you must be over 18 years of age, be resident in one of the countries where we offer Delivery and be the authorised user of a valid credit or debit card issued by a bank acceptable to us with sufficient funds to cover the cost of the goods.
c After placing an order you will receive an e-mail confirming we have received your order. This does not mean your order has been accepted. A contract between us will only be formed after we send an e-mail confirming the goods ordered by you have been dispatched. The contract will relate only to those goods listed in the e-mail confirming the goods that have been dispatched.
d We will not process your order until we receive payment in full.
e We have the right to refuse any order made by you for any reason.
2 Availability and Delivery
Dispatch times may vary according to availability. We will endeavour to deliver the goods as set out in our Dispatch Confirmation but any guarantees or representations made about delivery are subject to delays from postal delays or force majeure for which we will not be responsible. If no delivery date is specified then we will endeavour to deliver the goods within 30 days of the Dispatch Confirmation. Please see our Delivery pages before placing your order.
3 Price and Payment
a Prices shown on the website are inclusive of UK VAT. Delivery costs will be charged in addition and will be shown separately. Prices are subject to change without notice but not after we send an e-mail confirming the goods ordered by you have been dispatched.
b Payment will be made by the method specified on the website.
c We may periodically offer discount codes and if you use a discount code when ordering a product, it must be a code issued to you for use on your account and is not transferable.
d We may periodically offer promotional discount codes and only one promotional code may be used per order.
e Whilst we try and make sure that the details, descriptions and prices which appear on our website are accurate, errors may occur. If we discover an error in the price of goods which you have ordered we will let you know as soon as possible. You will have the option of re-confirming the order at the correct price or cancelling the order. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods we will issue a full refund.
f The cost of foreign products and services may fluctuate.

5 Consumer Rights
a Under the UK Distance Selling Regulations you have 7 working days, beginning on the day after you receive the goods, to cancel the contract. Please see our Returns pages.
b In order to exercise your right of cancellation you must provide us with written notice by e-mail.
6 Liability
a If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, our only obligation will be:
(i) to make good any shortage or non-delivery;
(ii) to replace or repair any goods that are damaged or defective; or
(iii) to refund to you the amount paid by you for the goods in question
b We shall have no liability to you for any indirect or consequential loss, damage or expenses including loss of profits, business or goodwill howsoever arising.
c We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods.
d Nothing in these conditions shall exclude or limit your statutory rights, our liability for death or personal injury due to our negligence, any liability which is due to our fraud or any other liability which we are not permitted to exclude or limit as a matter of law.
7 Intellectual Property and Content
All intellectual property rights, including trademarks and logos whether registered or unregistered, in connection with our website and content are owned by us absolutely. You agree not to reproduce, duplicate, copy or re-sell any part of our site without our permission.
8 Indemnity
You agree to indemnify, defend and hold harmless WHD, its officers, employees, consultants, agents and affiliates, from any and all third party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from, your breach of these terms and conditions or your use of this website.
9 Import Duties
a If you order goods from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the goods reach the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information.
b Please also note that you must comply with all applicable laws and regulations of the country for which the goods are destined. We will not be liable for any breach by you of any such laws.
10 Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
11 Notices
All notices given by you to us must be sent by e-mail to help@wantherdress.com. We may give notice to you at either the e-mail address or postal address you provide to us when placing an order, or in any of the ways specified in condition 10 above. Notice will be deemed received and properly served immediately when posted on the website, 24 hours after an email is sent, or three days after that date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
12 Privacy
Our privacy policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. By submitting your information and using our website, you consent to the collection, storage and processing of your personal information by us in the manner set out in our Privacy Policy.
13 Complaints
If you have a complaint please e-mail help@wantherdress.com. We follow a process when receiving a complaint and will endeavour to contact you within 7 working days of receiving your e-mail to try and resolve any problems quickly and fairly.
14 Waiver
a Failure or delay by us in enforcing or partially enforcing any provision of the contract shall not be construed as a waiver of any of our rights under the contract.
b Any waiver by us of any breach of, or any default under, any provision of the contract by you shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other terms of the contract.
15 Severability
If any provision of the contract or these terms and conditions is unenforceable (including any in which we exclude our liability to you) it will to that extent be severed and the remaining provisions of the contract or these conditions and the remainder of such provision shall continue in full force and effect.
16 Entire Agreement
a The above terms and conditions constitute the entire agreement between the parties and supersede any prior agreement, understanding or arrangement between us whether oral or in writing.
b Any waiver of any provision of the terms and conditions will only be effective if signed by the company’s nominated legal advisers, whose details can be provided on request.
17 Law and Jurisdiction
These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be resolved exclusively in the English Courts.
